A Study of the Longgang Qin Bamboo Slips Nos. 35–45: Legal Records on the Management of Flora and Fauna and Penal Regulations in the Forbidden Park
Abstract
This study deciphers the texts recorded on slips Nos. 35–45 of the Longgang Qin Bamboo Slips (龍崗秦簡) in order to examine the management regulations and specific penal provisions applied to the imperial Forbidden Park (jin yuan, 禁 苑) during the Qin dynasty. The contents of slips Nos. 35–45 can largely be divided into two thematic sections. Slips Nos. 35–39 primarily concern the management of flora and fauna within the Forbidden Park. The animal named yintu (陰荼), appearing in slips Nos. 35–36, seems to have been regarded as a formidable beast—probably a predator—whose escape required immediate reporting and capture, as prescribed by law. Slip No. 38 records the prohibition of collecting leaves and bark from certain trees identified by species, indicating that the park’s regulations extended to vegetation management as well. These records demonstrate that the Qin authorities had a clear understanding of plant classification and usage, and that the law imposed strict controls on the collection of plant materials, similar to its prohibitions on hunting. Slip No. 39 specifies the duties of inspection and reporting for park administrators, again underscoring the importance placed on preventing the escape of animals. Slips Nos. 40–45 contain provisions related to sentencing, aggravating circumstances, and administrative responsibility. Slips Nos. 40–41 reveal detailed standards for punishment in cases of theft and possession of stolen goods, including a compensatory system allowing offenders to redeem penalties with items of equivalent value. Slips Nos. 42 and 44 show the existence of an aggravation system applied to repeat offenders and responsible officials, while slip No. 46 (mentioned in relation to these) indicates that the legal framework not only governed individual crimes but also penalized official negligence and failures of supervision.
초록
본고는 진대(秦代)의 출토문헌인 龍崗秦簡의 제35∼45간을 해독하고 주석을 붙 인 것으로, 금원(禁苑) 내 동식물 관리와 형벌 규정을 중심으로 진률(秦律)의 실제 모습을 살펴보았다. 이 11매의 죽간에는 금원에서 관리하는 동식물에 대한 규정과 관리 책임자의 순찰 및 보고 의무 등이 기록되어 있어, 당시 국가가 동물뿐 아니라 식물까지도 세밀하게 관리했음을 보여준다. 또한 절도나 장물죄에 대한 형량 기준과 일정 금액의 재물로 속죄할 수 있는 규정, 누범자나 관리의 직무 태만에 대한 가중 처벌 조항을 통해 진대 법률의 체계성과 행정 책임의 엄격함을 확인할 수 있다. 아 울러 간문(簡文)에 보이는 ‘關’과 ‘罪’의 자형을 고찰하여, 진대의 문자 사용에 있어서 주목할만한 점들을 짚어보았다.
